Many of our clients live in New York and get hurt in New Jersey, or the other way around. Janai Jackson is admitted to practice in both states, so your case stays with one firm.
New Jersey law is not New York law. The deadlines are shorter and the fault rules are different.
New Jersey Cases We Handle
- Crashes on the Turnpike, the Parkway, and local roads
- Truck and commercial vehicle collisions
- Falls in stores, malls, and parking lots
- Negligent security and unsafe property
- Wrongful death
How New Jersey Is Different
- Two years. Most New Jersey injury lawsuits must be filed within two years of the accident, not three.
- Fault matters more. You can recover only if your share of the fault is not greater than the fault of the parties you are suing. Your award is reduced by your percentage.
- Injured in a New Jersey car accident? If your New Jersey auto policy has the “limitation on lawsuit” option, you can sue for pain and suffering only if your injury falls into certain serious injury categories.
- Public entities. A claim against the State, a county, a town, or another public entity generally requires a notice of claim within 90 days.
How We Build Your Case
The approach is the same on both sides of the river. Secure the evidence early, document the injuries fully, identify every responsible party and every policy, and prepare for trial.
What You Can Recover
- Medical bills, past and future
- Lost wages and loss of future earning ability
- Pain and suffering
- In death cases, the financial losses to the family
Deadlines
Most New Jersey injury lawsuits must be filed within two years. Wrongful death lawsuits generally must be filed within two years of the death. Notices of claim against public entities are generally due within 90 days.
Deadlines can be shorter or longer depending on the facts. Call before you assume it is too late or that you have time.
Common Questions
I live in Brooklyn and was hurt in New Jersey. Where is my case filed?
Usually where the accident happened or where the defendant is located. We evaluate the options and file where it is best for your case.
Do I need a separate New Jersey lawyer?
No. Ms. Jackson is admitted in New Jersey and handles the case directly.
I have New York insurance but crashed in New Jersey. Which rules apply?
It depends on the policies and the facts. Bring us your insurance declarations page and we will sort it out.
