Hit by an Uber or Lyft?

Rideshare insurance can depend on where the accident happened and what the driver was doing at the time, such as waiting for a ride request or carrying a passenger. In New York City, rideshare drivers are licensed by the Taxi and Limousine Commission and must carry commercial insurance. We can help figure out which policy applies to your accident.

Who We Represent

  • Passengers injured during a ride
  • People in other cars hit by a rideshare driver
  • Pedestrians and cyclists struck by a rideshare vehicle
  • Rideshare drivers hit by someone else

Which Insurance Applies

Coverage generally turns on the driver's status.

  • App off. The driver's own policy applies.
  • App on, waiting for a ride request. A different layer of coverage may apply.
  • Ride accepted or passenger in the car. The highest commercial coverage generally applies.

In New York City, rideshare vehicles are also licensed by the Taxi and Limousine Commission, which has its own requirements. We identify every policy early. Every case is different, and the rules that apply depend on the facts, the parties, and the insurance involved. Once we discuss your claim and complete the necessary research, our office will confirm which deadlines and coverage apply to you.

Evidence We Go After

  • Trip records and app data showing the driver's status
  • The driver's TLC and insurance records
  • Dash camera and street camera video
  • Your own ride receipt and screenshots

If You Were a Passenger

Passengers are almost never at fault. Take a screenshot of the trip in your app, get the police report number, and see a doctor. Do not rely on the company's in-app report as your only record.

Deadlines

No-fault benefits pay medical bills and part of lost wages, up to $50,000 per person, no matter who caused the crash. Written notice to the insurer is generally due within 30 days of the accident. There are some circumstances where the insurance company will make exceptions.

Most New York injury lawsuits must be filed within three years of the accident.

Common Questions

Can I sue Uber or Lyft directly?

Sometimes. These companies classify drivers as independent contractors, and they fight direct liability. The available insurance is usually the practical path to recovery, and we evaluate every option.

I drive for Uber and another car hit me. Can you help?

Yes. Your claim is against the driver who hit you, and your no-fault benefits still apply.

The app asked me to report the crash. Should I?

Reporting that a crash happened is fine. Do not give a detailed or recorded statement about your injuries before you speak with a lawyer.
