Companies that make and sell products are responsible for making them reasonably safe. When a defective product injures someone, the injured person does not have to prove the company meant any harm.

Three Kinds of Defects

  • Design defect. The product is dangerous as designed, and a safer design was feasible.
  • Manufacturing defect. This unit was built wrong and differs from the way it was supposed to be made.
  • Failure to warn. The product lacked adequate warnings or instructions about a danger the company knew or should have known about.

Products We See

  • E-bike and scooter batteries and chargers
  • Vehicle parts: tires, brakes, airbags, seat belts
  • Power tools, ladders, and job site equipment
  • Space heaters and kitchen appliances
  • Children's products and furniture that tips over
  • Medical devices

Who May Be Responsible

Injured by a defective product?

You may be able to hold responsible not just the manufacturer, but also the distributor and the store that sold it.

Keep the Product

  • Do not throw it away, repair it, or return it to the store or the manufacturer.
  • Keep the packaging, manual, receipt, and any recall notice.
  • Photograph the product and the scene.
  • Write down where and when you bought it.

Without the product, these cases are very hard to prove. If it is in someone else's hands, tell us and we will send a preservation demand.

What You Can Recover

  • Medical bills, past and future
  • Lost wages and loss of future earning ability
  • Pain and suffering
  • Loss of enjoyment of life

Deadlines

Most New York injury lawsuits must be filed within three years of the accident.

Deadlines can be shorter or longer depending on the facts. Call before you assume it is too late or that you have time.

Common Questions

I was not using the product exactly as the instructions said. Do I still have a case?

Possibly. Companies must account for uses they can reasonably foresee. You can still recover in New York. Your award is reduced by your share of the fault. It is not wiped out.

The product was recalled after I was hurt. Does that help?

It can be strong evidence that the company knew of the danger. A recall is not required to bring a claim.

I was hurt by a machine at work. Can I sue?

You generally cannot sue your employer, but you can bring a claim against the manufacturer or the company that maintained the machine.
